Agreement

This website, www.cashbalanceconsultants.com, is operated by Cash Balance Consultants LLC ("CBC," "we," "us"). By using the site or texting a CBC number, you agree to these terms and to our privacy policy. If you do not agree, please do not use the site or the text message service. Services CBC provides to a retirement plan are governed by the engagement agreement for that plan, which controls if it conflicts with these terms.

No tax, legal, or investment advice

Content on this site is general information about cash balance and other retirement plans. It is not tax, legal, or investment advice, and using the site does not create a client relationship with CBC. Consult your own tax and legal advisors about your situation.

Estimates and illustrations

Contribution and tax figures shown on the site, including in the tax deduction calculator, are estimates for illustration only and are not a guarantee of results. Actual amounts depend on age, compensation, the employee census, plan design, and IRS limits for the plan year. A formal illustration from our actuaries is based on the information you provide, and its accuracy depends on that information.

Use of the site

You agree not to:

• Use the site in violation of any law.
• Interfere with the site's operation or security, or try to gain unauthorized access to any system.
• Submit false information, or information about another person without the right to share it.
• Send Social Security numbers, account numbers, or passwords through the site's forms or by text message.

Intellectual property

The site's content, design, and the Cash Balance Consultants name and logo belong to CBC. You may view and print pages for your own use or to share with a client or advisor, but you may not otherwise copy, modify, or redistribute them without our written permission. The downloadable census template may be used to prepare information for CBC.

Third-party links

The site may link to websites run by others. We are not responsible for their content or privacy practices.

Text messaging

Cash Balance Consultants lets clients and their advisors text individual CBC team members at their direct business numbers. These terms apply to that text message service. By texting a CBC number, you agree to them. Our privacy policy explains how we handle text message information.

The service

• Cash Balance Consultants' text message service is person-to-person conversation between you and a CBC team member about your retirement plan, your engagement with CBC, scheduling, and requests for documents or information.
• We do not send marketing, promotional, or automated bulk messages.
• You start the conversation. CBC team members publish their direct numbers in their email signatures and correspondence. A conversation begins when you text one of those numbers. Your first message will receive an automatic reply confirming the service and explaining how to get help or opt out.
• Do not text Social Security numbers, account numbers, passwords, or other sensitive identifiers. A CBC team member will ask you to send those through a secure channel instead.

Message frequency and cost

• Message frequency varies. It depends on the conversation you have with your CBC contact.
• CBC does not charge for text messages. Message and data rates may apply from your mobile carrier.

Opting out

• Reply STOP to any message to stop receiving texts from that CBC number. You can also reply QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE.
• An opt-out applies to the specific CBC number you reply to. We'll send one text confirming the opt-out.
• Reply START to resume messages from that number.

Electronic records

You agree that these terms, and records of your consent and opt-out, may be kept in electronic form. You can withdraw consent to text messaging at any time by replying STOP.

Carriers are not liable for delayed or undelivered messages.

Disclaimers and limitation of liability

The site and its content are provided "as is," without warranties of any kind, to the extent the law allows. CBC is not liable for any indirect, incidental, or consequential damages arising from your use of the site or reliance on its general information. Nothing in these terms limits obligations CBC has under an engagement agreement or that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.

Changes to these terms

We may update these terms. The "Last updated" date at the top shows the latest version. Continuing to use the site or to text a CBC number after a change means you accept the updated terms.
